Terms of Service

Photo Guarantee: Bree Vandenberg Photography will make every effort to ensure the final images are of high quality and represent the property in the best way. Sometimes however, a Client may feel these images do not meet those expectations. In this case, Bree Vandenberg Photography will work closely with the Client to correct the issue and photos. A reasonable amount of re-editing will be performed at no additional cost. Everyone has a different idea of their "best photo" but prior to hiring Bree Vandenberg Photography, please provide detail and specific requirements as there will be no refunds issued to clients who are not happy with the "style" of photography. “Style” refers to image angles, color, and any other visual aspect of the photo.

Cancellation and Rescheduling: Any cancellation without proper communication from the Client to the Photographer, within 1 hour of the shoot or once the photographer has arrived will be subject to 50% of the package amount.

Weather Policy: Bree Vandenberg Photography photographs in all weather with the exception to weather that may potential cause damage to photography equipment (heavy rain or snow). If heavy rain or snow is present the client will be given the option to reschedule at no additional charge. However, the weather should be evaluated at least 24 hours prior to the shoot to prevent any rescheduling. The weather policy does not cover rescheduling or cancelling under 24 hours due to cloudy weather or lack of sun (rain or snow must be present in order for the fee to be waived).

Travel Surcharge: Sessions outside of the Campbell River/Black Creek area are subject to a minimum travel fee of $20 depending on distance. A larger travel surcharge will be assessed for properties significantly out of range. Properties in rural or remote areas may be subject to additional travel fees depending on the extent of the distance from a major paved roadway.

Right to Refuse: Bree Vandenberg Photography reserves the right in its sole discretion to refuse service at any time for any reason. At any time, Bree Vandenberg Photography can terminate the relationship with or fire a client for overdue invoices, poor communication, or unreasonable requests.

Payment: Payment is expected within 7 days of delivery of the "proof" images to client, or the stated due date on the invoice. Failure to pay by due date will result in a 2% fee assessed daily. Failure to pay an invoice past due of 30 days or more may result in legal action. Timely payment is expected as Bree Vandenberg Photography does not require payment prior to a shoot.

Limitation of Liability

• Session: In the event Photographer is unable to perform the duties stated in Agreement for any unforeseen reasons or circumstances beyond the control of Photographer, the session will be rescheduled as soon as possible. If the Photographer cannot provide rescheduling for the session, any and all fees already paid by Client will be returned. Client has the right to refuse any pose or location.

• Safety: It is the responsibility of Client and/or guardian(s) of Client, to refuse to stand or be placed in any position or location where they feel uncomfortable or endangered. If Client and/or guardian(s) of Client, agree to stand or be placed in any position or location during the session, they assume all risks associated with the position and location. Photographer will not be responsible for any personal injury and/or property damage that might result from Client and/or guardian(s) being injured during a session.

• Images: Unless otherwise agreed upon, digital images will be delivered to Client electronically over the internet (an internet photo gallery site). Once the images are delivered to Client, Photographer will not permanently archive the images. Photos will be taken offline 60 days after delivery. It is Client's responsibility to back-up and protect the photographs. It is highly recommended to download the photos immediately after receiving the final download link as this will ensure no future issues.

Copyright Notice:  Bree Vandenberg Photography is the exclusive copyright holder of the image. Full image rights are not sold or granted, clients only receive licenses. Bree Vandenberg Photography reserves the right to use images from your session for marketing and promotional purposes. This includes, but is not limited to, use on the business website, within the blog, on business social media pages, and printed as magazines, flyers, postcards, etc.

*The Client can request images and videos from your session to be removed from the business website, blog, or social media pages by writing to bree@breevandenberg.com. In this instance, the photos and videos will be removed.

 

In booking a session with Bree Vandenberg Photography, you are confirming that you have read, and accept, the Terms & Conditions.

If you do not wish to be bound by these terms and conditions, please do not use the photographic services of Bree Vandenberg Photography.

Bree Vandenberg Photography retains the right to change the above terms at any time without notice.
